End User License Agreement (EULA)

This End User License Agreement (“Agreement” or “EULA”) is a legal agreement between you (“User,” “you,” or “your”) and Disk Fresh (“Disk Fresh,” “we,” “our,” or “us”) governing your installation and use of the Disk Fresh software, updates, and related documentation (collectively, the “Software”).

By downloading, installing, activating, or using the Software, you agree to be bound by this Agreement. If you do not agree to these terms, do not install or use the Software.

1. License Grant

Subject to your compliance with this Agreement and an active subscription, Disk Fresh grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Install the Software on eligible Windows devices covered by your subscription.
  • Use the Software for your personal or internal business purposes.
  • Receive software updates available during your active subscription.

This license does not transfer ownership of the Software.

2. Ownership

The Software is licensed, not sold.

Disk Fresh and its licensors retain all rights, title, and interest in the Software, including all copyrights, trademarks, trade secrets, patents, and other intellectual property rights.

3. License Restrictions

You may not:

  • Copy or reproduce the Software except for a reasonable backup copy where permitted by law.
  • Modify, adapt, translate, or create derivative works.
  • Reverse engineer, decompile, or disassemble the Software except where expressly permitted by applicable law.
  • Remove copyright notices or proprietary markings.
  • Sell, sublicense, rent, lease, distribute, or commercially exploit the Software.
  • Share or transfer license keys without our written permission.
  • Circumvent activation, licensing, or security mechanisms.
  • Use the Software for unlawful or fraudulent purposes.

4. Subscription Requirement

Certain features require an active paid subscription.

If your subscription expires or is cancelled:

  • Premium features may become unavailable.
  • Technical support may be limited or discontinued.
  • You may continue using any features designated as free, if applicable.

5. Software Updates

Disk Fresh may automatically download and install:

  • Security updates
  • Bug fixes
  • Performance improvements
  • Compatibility updates
  • New features

These updates help maintain the security, stability, and functionality of the Software.

6. Remote Technical Support

If you request remote technical support:

  • Remote access occurs only with your explicit consent.
  • You may end the session at any time.
  • Support is provided solely to diagnose or resolve the issue you reported.
  • Disk Fresh does not intentionally access personal files unless necessary for the requested support.
  • You are responsible for maintaining backups of your important data before any support session.

7. Internet Connectivity

Certain features, including activation, license verification, updates, and online services, require an active internet connection.

Your internet service provider may apply normal data charges.

8. Privacy

Your use of the Software is also governed by the Disk Fresh Privacy Policy, which explains how we collect, use, and protect your information.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Software is provided “AS IS” and “AS AVAILABLE.”

Disk Fresh does not guarantee that:

  • The Software will operate without interruption.
  • Every computer issue can be detected or resolved.
  • The Software will improve performance on every device.
  • The Software will be free from defects or errors.

No oral or written advice creates any additional warranty.

10. Limitation of Liability

To the fullest extent permitted by law, Disk Fresh shall not be liable for:

  • Loss of data
  • Loss of profits
  • Business interruption
  • Indirect or consequential damages
  • Damage caused by third-party software, malware, hardware failure, operating system issues, or user actions

Our total liability arising from this Agreement shall not exceed the amount you paid for the Software during the twelve (12) months preceding the claim.

Nothing in this Agreement limits liability where such limitation is prohibited by law.

11. Termination

This license automatically terminates if:

  • You violate this Agreement.
  • Your subscription is terminated due to fraud or non-payment.
  • Required by applicable law.

Upon termination, you must stop using the Software and delete all installed copies where required.

12. Export Compliance

You agree to comply with all applicable export control and trade laws governing the Software.

You may not use or export the Software where prohibited by applicable law.

13. Governing Law

This Agreement is governed by the laws applicable to the legal entity operating Disk Fresh, unless mandatory consumer protection laws require otherwise.

14. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

This Agreement, together with the Privacy Policy, Terms of Service, and Refund & Cancellation Policy, constitutes the entire agreement between you and Disk Fresh regarding the Software.
