Please read these Terms and Conditions (“Terms”, “Terms of Service”) carefully before downloading, installing, or using the DiskFresh application, website, or associated services (collectively, the “Service”) operated by DiskFresh (“us”, “we”, or “our”).

By installing, accessing, or using DiskFresh, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access or use the software.

1. SOFTWARE LICENSE GRANT

Subject to your compliance with these Terms, DiskFresh grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the software strictly in accordance with your tier (e.g., Personal, Commercial, or Enterprise):

  • Personal License: Permitted for individual, non-commercial use on designated personal devices.
  • Commercial/Enterprise License: Permitted for operational use within a business, organization, or managed IT environment up to the specified device limit.
2. USE RESTRICTIONS

You explicitly agree not to, and will not permit any third party to:

  • Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code or underlying algorithms of DiskFresh.
  • Rent, lease, sublicense, resell, distribute, or transfer the software or your license key to any third party without explicit written consent from DiskFresh.
  • Modify, adapt, translate, or create derivative works based upon DiskFresh.
  • Bypass, defeat, or tamper with any security mechanisms, license activation checks, or digital rights management protocols inside the software.
  • Use DiskFresh for any illegal purpose or in violation of any local, state, national, or international law.
3. USER RESPONSIBILITIES & DATA BACKUPS
  • System Modifications: You acknowledge that DiskFresh performs deep system cleaning, temporary file deletion, cache clearing, startup item management, and registry/disk optimizations.
  • Backup Obligation: While DiskFresh is engineered with safety protocols to prevent critical system file removal, you are solely responsible for creating complete, regular backups of your important files, documents, and system state before executing optimization routines.
  • Irreversible Deletion: Tools such as permanent shredding or deep space cleaning physically overwrite or remove data. DiskFresh cannot restore data permanently removed by user command.
4. LICENSING, BILLING, AND REFUNDS
  • Subscription & One-Time Keys: Access to premium modules requires a valid license key or active subscription. Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date.
  • Payment Processing: All transactions are processed by PCI-compliant third-party payment providers (e.g., Stripe, PayPal). You agree to provide current, complete, and accurate purchase and account information.
  • 30-Day Guarantee: We offer a 30-day money-back guarantee for initial direct purchases made on our website. Refund requests after 30 days are handled at our sole discretion.
5. AUTOMATIC UPDATES & TELEMETRY
  • Software Updates: DiskFresh may automatically download and install updates, patches, or performance improvements to ensure security and stability.
  • Diagnostic Telemetry: To help us optimize software performance across various hardware setups, DiskFresh collects minimal, non-identifiable system diagnostics in accordance with our [Privacy Policy]. You can opt out of non-essential diagnostic collection inside Settings > Privacy.
6. INTELLECTUAL PROPERTY RIGHTS

The DiskFresh application, including its source code, UI/UX design, visual branding, logos, graphics, and documentation, is the exclusive property of DiskFresh and its licensors. It is protected by copyright, trademark, and other intellectual property laws.

7. DISCLAIMER OF WARRANTIES

DISKFRESH IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DISKFRESH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  1. IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  2. THAT THE SOFTWARE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.
  3. THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED, SECURE, OR COMPLETELY ERROR-FREE.
8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DISKFRESH, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, SYSTEM DOWN TIME, HARDWARE FAILURE, OR BUSINESS INTERRUPTION—ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SOFTWARE.

IN NO CASE SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE AMOUNT PAID BY YOU TO DISKFRESH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. TERMINATION

We reserve the right to suspend or revoke your license key and access to DiskFresh immediately, without prior notice or refund, if you breach any term or restriction outlined in these Terms.

10. GOVERNING LAW AND RESOLUTION

These Terms shall be governed, construed, and enforced in accordance with applicable laws, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the appropriate court of jurisdiction.

11. CHANGES TO THESE TERMS

We reserve the right to revise or update these Terms at any time. When changes occur, we will update the “Last Updated” date at the top of this document. Continued use of DiskFresh after modifications become effective constitutes acceptance of the revised Terms.
