Welcome to Disk Fresh (“Disk Fresh,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Disk Fresh website, software, subscriptions, and related technical support services.

By accessing our website, downloading our software, purchasing a subscription, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our products or services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Disk Fresh.

2. Services

Disk Fresh provides:

  • PC optimization software
  • Performance monitoring and maintenance tools
  • Monthly software subscription
  • Optional one-on-one remote technical support
  • Product updates
  • Customer support

We reserve the right to improve, modify, suspend, or discontinue any feature or service at any time.

3. Subscription

Your purchase provides access to the selected Disk Fresh subscription plan.

Your subscription includes:

  • Software updates during your active subscription
  • Access to premium features included in your plan
  • Technical support as described on our website

Your subscription remains active until cancelled or terminated.

4. Billing & Renewal

Subscriptions are billed monthly.

Unless cancelled before the next billing date, your subscription automatically renews each month using your selected payment method.

By purchasing a subscription, you authorize Disk Fresh or its payment provider to process recurring subscription payments until cancellation.

You may cancel your subscription at any time through your customer account or by contacting support@diskfresh.com.

Cancellation prevents future renewals but does not automatically entitle you to a refund except as described in our Refund Policy.

5. Free Trial (If Offered)

If Disk Fresh offers a free trial, the trial will automatically convert to a paid subscription unless cancelled before the trial period ends.

The trial length and applicable pricing will be displayed before enrollment.

6. License

Subject to these Terms, Disk Fresh grants you a limited, non-exclusive, non-transferable, revocable license to install and use the software for your personal or internal business use.

You may not:

  • Copy or redistribute the software except as permitted by law.
  • Reverse engineer, decompile, or modify the software.
  • Resell, sublicense, rent, or lease the software.
  • Use the software for unlawful purposes.
  • Circumvent licensing or security mechanisms.

All intellectual property rights remain the exclusive property of Disk Fresh.

7. Remote Technical Support

Remote support is optional and provided only at your request.

By requesting remote assistance, you acknowledge that:

  • You voluntarily authorize our technician to access your computer.
  • You may observe the session at all times.
  • You may terminate the session at any time.
  • Access is limited to diagnosing and resolving the issue you reported.
  • We will not intentionally access personal files unless you request assistance involving those files.
  • We do not intentionally collect or store passwords.
  • You are responsible for backing up your data before any support session.

While our technicians exercise reasonable care, Disk Fresh is not responsible for the loss of personal data resulting from existing hardware failures, malware, operating system issues, or circumstances beyond our reasonable control.

8. Customer Responsibilities

You agree to:

  • Provide accurate account information.
  • Maintain the confidentiality of your account credentials.
  • Use Disk Fresh only for lawful purposes.
  • Maintain backups of important files.
  • Keep your operating system updated.
  • Cooperate with technical support during troubleshooting.
9. Acceptable Use

You agree not to:

  • Use Disk Fresh for illegal activities.
  • Attempt unauthorized access to our systems.
  • Interfere with our services.
  • Distribute malware using our products.
  • Misuse customer support resources.
  • Violate applicable laws or regulations.

We may suspend or terminate accounts engaged in prohibited activities.

10. Refunds

Refunds are governed by our separate Refund Policy.

Eligible customers may request a refund within 30 days of the original purchase, subject to the terms of that policy.

11. Software Updates

Disk Fresh may automatically install updates, bug fixes, security patches, and feature improvements to maintain compatibility, security, and performance.

12. Disclaimer of Warranties

Disk Fresh is provided on an “AS IS” and “AS AVAILABLE” basis to the fullest extent permitted by law.

While we strive to improve computer performance and resolve technical issues, we do not guarantee that:

  • Every issue can be diagnosed or repaired.
  • Software will be uninterrupted or error-free.
  • Every computer will experience measurable performance improvements.
  • The software will detect or remove every problem affecting your computer.
13. Limitation of Liability

To the maximum extent permitted by law, Disk Fresh shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of business, loss of data, or interruption of service arising from the use of our software or services.

Our total liability for any claim shall not exceed the amount you paid to Disk Fresh during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded.

14. Indemnification

You agree to indemnify and hold harmless Disk Fresh, its officers, employees, contractors, and affiliates from claims, damages, liabilities, and expenses arising from your misuse of the software or violation of these Terms.

15. Intellectual Property

All software, trademarks, logos, graphics, content, documentation, and other intellectual property associated with Disk Fresh remain the exclusive property of Disk Fresh.

No ownership rights are transferred to you through your purchase or use of our products.

16. Termination

We may suspend or terminate access if:

  • These Terms are violated.
  • Fraudulent activity is detected.
  • Payment obligations are not met.
  • Continued access would pose a security or legal risk.

Termination does not affect any rights or obligations accrued before termination.

17. Governing Law

These Terms shall be governed by the laws applicable to the legal entity operating Disk Fresh, without regard to conflict of law principles, unless mandatory consumer protection laws require otherwise.

18. Changes to These Terms

We may update these Terms from time to time.

Material changes will become effective when the revised Terms are published on our website with an updated Effective Date.

Continued use of Disk Fresh after such changes constitutes acceptance of the revised Terms.
